Overview
These Terms and Conditions govern access to and use of CampaignGateway, including the CampaignGateway website, account dashboard, campaign management tools, public campaign pages, forms, communications features, and related services.
By creating an account, accessing the platform, submitting information, or using any CampaignGateway feature, you agree to these Terms. If you are using CampaignGateway on behalf of a campaign, organization, candidate, committee, company, or other entity, you confirm that you have authority to accept these Terms for that entity.
Plain-Language Summary
CampaignGateway provides campaign website, data, volunteer, outreach, scheduling, and communications tools. You are responsible for the information you upload, publish, send, import, or manage through the platform. You must use the service lawfully, keep account access secure, respect privacy and election rules, and avoid misuse of the platform.

Eligibility and Account Responsibility
You must provide accurate account information and keep it up to date. You are responsible for activity that occurs under your account, including activity by campaign staff, volunteers, contractors, administrators, or any other users you authorize.
You are responsible for maintaining the confidentiality of login credentials, two-factor authentication codes, and account access links. You must notify CampaignGateway promptly if you believe an account has been accessed without authorization.
Campaign and User Content
You retain responsibility for campaign content, public page content, uploaded files, voter or supporter records, volunteer information, donor or ticket information, images, videos, logos, messages, notes, schedules, event details, and any other material entered into CampaignGateway.
You represent that you have the rights and permissions required to upload, publish, process, or send that content. You must not upload or publish material that is unlawful, misleading, defamatory, discriminatory, infringing, malicious, or otherwise harmful.
Public Pages and Published Information
CampaignGateway may allow you to create public campaign pages, blog-style posts, event pages, forms, sign-up pages, contact pages, donation or payment links, and other public-facing material.
You are responsible for reviewing public pages before publishing and for ensuring that names, titles, authorization lines, official agent information, disclaimers, contact details, pricing, event details, and campaign claims are accurate and compliant with applicable rules.
Compliance With Laws and Rules
You are responsible for using CampaignGateway in compliance with all applicable laws, regulations, platform rules, election rules, campaign finance rules, privacy laws, anti-spam laws, accessibility obligations, payment rules, and recordkeeping requirements.
CampaignGateway does not provide legal, accounting, campaign finance, election law, or compliance advice. The platform may provide templates, labels, reminders, or suggested language, but those tools do not replace professional advice or official guidance.
Voter, Supporter, Volunteer, and Contact Data
CampaignGateway may allow campaigns to import, store, update, search, tag, export, or delete voter, supporter, volunteer, donor, event, ticket, and contact information.
You are responsible for ensuring that you have a lawful basis to collect, import, use, disclose, retain, contact, and delete any personal information you manage through the platform. You are also responsible for the accuracy of uploaded data and for avoiding improper or unauthorized use of data.
Communications and Email Features
If you use CampaignGateway to send or manage email, notifications, event messages, post alerts, volunteer reminders, receipts, or other communications, you are responsible for ensuring that messages are lawful and properly authorized.
You must not use CampaignGateway to send spam, deceptive messages, unlawful political communications, unlawful commercial electronic messages, malware, phishing attempts, harassment, or messages that violate consent, unsubscribe, identification, or disclosure requirements.
Payments, Donations, Tickets, and Third-Party Providers
CampaignGateway may connect to or support third-party payment providers, email providers, analytics providers, hosting providers, map providers, or other external services. Third-party services are governed by their own terms, privacy policies, fees, restrictions, and account requirements.
CampaignGateway is not responsible for third-party service outages, refusals, holds, suspensions, chargebacks, disputes, processing delays, account closures, deliverability issues, or policy decisions. You are responsible for reviewing third-party requirements and maintaining your own accounts with those providers where applicable.
Fees, Plans, Renewals, and Access
Paid plans, subscription periods, expiry dates, trial periods, one-time fees, discount codes, and included features may be shown during registration, checkout, or account management. Unless otherwise stated, fees are charged in the displayed currency and are not guaranteed to include taxes, third-party processing fees, or other charges.
Access to paid features may end when a plan expires, payment fails, a dispute occurs, an account is cancelled, or the service is suspended under these Terms.
Data Retention and Deletion
CampaignGateway may delete, purge, anonymize, or restrict access to account data after plan expiry, account cancellation, non-payment, inactivity, security concerns, legal requirements, or operational limits. Some records may remain in backups, logs, transaction records, audit records, email records, or third-party systems for a limited period as needed for security, legal, accounting, dispute, or operational purposes.
You are responsible for exporting information you need before an account expires or is deleted, where export tools are available.
Acceptable Use
You must not use CampaignGateway to:
- violate laws, election rules, privacy rules, anti-spam rules, payment rules, or third-party platform policies;
- upload malware, exploit code, or harmful files;
- attempt to bypass authentication, security controls, rate limits, or access restrictions;
- access, scrape, export, or process data without authorization;
- impersonate another person or organization;
- publish deceptive, fraudulent, or materially misleading information;
- interfere with the operation, performance, reliability, or security of the service;
- use the service in a way that could expose CampaignGateway, other users, or the public to unreasonable risk.
Security
CampaignGateway uses reasonable technical, administrative, and organizational safeguards designed to protect the service. No online service can be guaranteed to be error-free or completely secure.
You are responsible for using strong passwords, protecting devices, limiting account access, removing users who no longer need access, and reporting suspected security issues.
Availability and Changes to the Service
CampaignGateway may change, update, add, remove, suspend, or discontinue features at any time. The service may be unavailable due to maintenance, upgrades, outages, provider issues, security events, internet failures, or circumstances outside our control.
We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free, or permanent availability.
Intellectual Property
CampaignGateway, including its name, branding, interface design, software, templates, layouts, icons, workflows, and related materials, is owned by CampaignGateway or its licensors except where otherwise stated.
You may not copy, resell, reverse engineer, reproduce, or create competing products from CampaignGateway materials except as permitted by law or by written permission.
Your own campaign content remains your responsibility and, where applicable, your property or the property of your licensors.
Feedback
If you provide feedback, ideas, feature requests, bug reports, screenshots, suggestions, or other comments, CampaignGateway may use them to improve the service without obligation to compensate you.
Account Suspension or Termination
CampaignGateway may suspend, restrict, or terminate access if we believe an account violates these Terms, creates legal or security risk, causes operational harm, fails to pay required fees, misuses third-party services, or otherwise threatens the integrity of the platform.
Where reasonable, we may provide notice or an opportunity to resolve the issue, but we are not required to do so where urgent action is needed.
Disclaimers
CampaignGateway is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, CampaignGateway disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.
Templates, dashboards, labels, suggested text, automations, analytics, summaries, or alerts are provided for convenience and may not be complete, current, or suitable for your specific circumstances.
Limitation of Liability
To the maximum extent permitted by law, CampaignGateway and its owners, operators, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost campaign opportunities, reputational harm, payment disputes, message deliverability issues, or service interruptions.
Where liability cannot be excluded, liability is limited to the amount paid to CampaignGateway for the affected service during the three months before the event giving rise to the claim, or the minimum amount permitted by law.
Indemnity
You agree to indemnify and hold CampaignGateway harmless from claims, losses, damages, penalties, costs, and expenses arising from your use of the service, your content, your data, your communications, your violation of these Terms, or your violation of applicable law or third-party rights.
Changes to These Terms
CampaignGateway may update these Terms from time to time. The updated version will be posted with a revised last-updated date. Continued use of the service after changes are posted means you accept the updated Terms.
Governing Law
Unless a different jurisdiction is required by applicable law, these Terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
